How Indonesia’s New Oil and Gas Law Can Lead on Sustainability, Fairness, and Investment
Indonesia gets to rewrite its oil and gas law roughly once every twenty-five years. It is doing so now. In August 2026, the House of Representatives approved a new Oil and Gas Bill as its own legislative initiative, opening formal negotiations with the government that could produce a new law before this year is out. The law it would replace, enacted in 2001, has outlived one of its own core institutions and predates almost every modern benchmark now used to judge how responsibly an energy company operates.
This paper argues that Indonesia’s sustainability agenda and its investment agenda are not competing priorities — they are the same agenda. A law built around strategic social investment, fair transition financing, radical transparency, and genuine community partnership will not slow investment. It will attract the capital Indonesia needs to reverse a decade of production decline, while distributing the industry’s benefits and burdens far more fairly than the 2001 law ever did.

Artikel ini meresensi buku Contested Consultations in the Extractive Industries yang menyoroti kegagalan struktural praktik konsultasi publik di sektor ekstraktif global, di mana konsultasi sering kali terlambat atau sekadar formalitas. Buku tersebut mengajukan tesis bahwa konsultasi merupakan sebuah rezim yang maknanya masih terus diperebutkan oleh negara, korporasi, masyarakat adat, dan masyarakat sipil. Penulis mengapresiasi penggunaan teori rezim, perpaduan perspektif akademisi dan praktisi, serta luasnya cakupan geografis dalam buku ini. Namun, terdapat kritik atas absennya studi kasus dari Asia Tenggara, khususnya terkait tantangan hilirisasi mineral kritis dan kondisi ruang sipil yang terbatas. Kontekstualisasi untuk Indonesia memberikan lima pelajaran krusial bagi perusahaan ekstraktif: perlunya konsultasi bermakna dua arah, pengakuan masyarakat lokal sebagai pemegang hak (rights-holders), mekanisme persetujuan yang berkelanjutan, keterwakilan yang inklusif, serta penghormatan terhadap waktu dan konteks lokal. Artikel ini membahas urgensi transformasi digital dalam pengukuran Social Return on Investment (SROI), yang mengubah prosesnya dari sekadar laporan evaluasi akhir tahun menjadi “sistem saraf” yang responsif. Praktik SROI tradisional secara manual sering menghasilkan data yang terlambat untuk pengambilan keputusan, sehingga gagal memenuhi Prinsip ke-8 Social Value, yakni Be Responsive. Prinsip tersebut menuntut organisasi untuk bertindak secara tepat waktu agar dapat memaksimalkan dampak positif dan segera menghentikan dampak negatif. Untuk mencapai hal ini, digitalisasi SROI diperlukan melalui pengumpulan data dari titik layanan secara langsung, otomasi proksi finansial, serta pemanfaatan kecerdasan buatan untuk memproses data kualitatif. Penerapan dasbor pemantauan waktu nyata terbukti memungkinkan organisasi merespons dampak sosial saat program masih berjalan. Meskipun demikian, teknologi digital tidak dapat menggantikan kearifan kontekstual manusia dan tetap bergantung pada kualitas data dasar di lapangan. Selain itu, kepatuhan terhadap perlindungan data pribadi juga menjadi prasyarat penting dalam praktiknya. Kesimpulannya, digitalisasi SROI merupakan upaya strategis untuk membangun sistem pelaporan yang hidup, guna memastikan organisasi mampu merasakan dan merespons dampak kerjanya sebelum momentum bertindak hilang.
